1. Who we are
This Website and these services are provided by MexPat Movers LLC (“MexPat,” “Company,” “we,” “us,” “our”).
2. Acceptance of these Terms
By accessing our website or requesting/booking services, you agree to these Terms. If you do not agree, do not use the website or our services.
PART A — WEBSITE TERMS OF USE
3. Website use and acceptable use
You agree not to misuse the website, including attempting to access non-public areas, introduce malware, scrape content, or interfere with site operation.
We may restrict access to the website at any time for security, maintenance, or legal reasons.
4. Intellectual property
All website content (text, logos, images, designs) is owned by MexPat Movers LLC or its licensors and may not be copied or used without written permission, except for personal, non-commercial viewing.
5. Third-party links
Our website may link to third-party sites. We do not control them and are not responsible for their content or privacy practices.
6. No warranties (website)
The website is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.
PART B — SERVICE TERMS (MOVING / TRANSPORT)
7. Quotes, estimates, and scope
- Any quote is based on the information you provide (inventory, addresses, access, timing, special items).
- Unless explicitly labeled binding in writing, quotes are non-binding and may change if scope changes (extra items, long carries, stairs, delays, special handling, etc.).
- Additional services requested during the job may be billed at the applicable rate.
8. Deposits and payment
- A deposit may be required to reserve your date.
- Unless otherwise agreed in writing, payment is due before delivery/release of goods.
- Late balances may accrue interest at 1.5% per month (or the maximum permitted by law).
- We may charge reasonable fees for failed payments or chargebacks.
9. Customer responsibilities
You agree to:
- Provide accurate item lists and disclose fragile/high-value/special items.
- Ensure access (parking, gate codes, elevator reservations, permits).
- Be present or have an authorized representative at pickup and delivery.
- Ensure items are legally transportable and properly documented.
10. Prohibited or restricted items
We do not transport hazardous materials, flammables, explosives, illegal drugs, or other restricted items. We may refuse service if prohibited items are present or suspected.
11. Scheduling, delays, and delivery windows
Arrival times and delivery windows are estimates unless guaranteed in writing. Delays due to weather, traffic, mechanical issues, labor disruptions, or government inspections are not a breach of contract.
12. Cancellations and rescheduling
- Cancellation or reschedule fees may apply based on how close to the job date changes occur.

Option A (simple):
- 7+ days: deposit refundable minus admin fee
- 3–6 days: deposit forfeited
- 0–2 days: may be charged up to full service
Option B (cleaner):
- Deposit is non-refundable within [X] days of service date due to staffing and scheduling costs.

13. Valuation, liability, and claims
13.1 Basic liability (unless you buy additional coverage)
Unless you purchase additional valuation coverage in writing, our liability is limited to $0.60 per pound per article, to the extent permitted by applicable law and consistent with household goods carrier standards.
13.2 Additional valuation
You may have the option to purchase additional valuation/coverage. If offered, those terms will be provided in writing and may be subject to exclusions and deductibles.
13.3 Exclusions
We are not liable for:
- Normal wear and tear
- Pre-existing damage
- Mechanical/electrical failure of items
- Damage caused by customer-packed boxes (unless otherwise agreed)
- Damage from improper or inadequate packaging supplied by the customer
- Force majeure events (see Section 18)
13.4 Claims process and deadlines
All claims must be submitted in writing to info@mexpatmovers.com within 9 months of delivery (or other legally required timeframe). You should keep photos and supporting documentation.
14. Storage and liens
If goods are held due to customer delay, inability to deliver, non-payment, or refusal of delivery:
- Storage fees may apply (daily/weekly/monthly).
- We may transfer goods to a storage facility at your expense.
- We may assert a lien and enforce it as permitted by California law and other applicable laws.
15. Cross-border services (U.S./Mexico) — important
For cross-border moves/transport:
- You are responsible for providing accurate documentation (registration, IDs, permits, insurance, inventories, etc.) unless we have agreed in writing to obtain items on your behalf.
- Customs inspections may require unloading/reloading at your expense.
- We are not liable for delays, seizures, penalties, or extra costs arising from inaccurate documents, prohibited items, or government actions.
16. Indemnification
You agree to defend and indemnify MexPat Movers LLC for claims, damages, penalties, or costs arising from prohibited items, inaccurate information, or legal non-compliance related to your shipment.
17. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages (including lost profits). Our total liability will not exceed the amount paid for the services at issue (unless prohibited by law).
18. Force majeure
We are not responsible for failure or delay caused by events beyond reasonable control, including natural disasters, acts of government, border closures, inspections, strikes, and transportation interruptions.
19. Governing law and venue
These Terms are governed by California law. Any dispute will be handled in courts located in San Diego County, California, unless otherwise required by law.
20. Changes to these Terms
We may update these Terms. The version in effect at the time you book services applies to that transaction.
